US Firms & their subsidiaries of Indian IT giants such as Wipro, Infosys and TCS will be moving applications under H-1B visa programme for highly skilled foreign workers from Today. The policies of Trump Administration makes it the toughest ever H-1B visa process.

Indians are the major beneficiary of the H-1B visa programme. Almost 70 percent of the visa issued under STEM fields (Science, Technology, Engineering and Maths) were bagged by Indians in 2016.

In the past few years, H-1B Visa filing process didn't last for more than five days as US Immigration and Citizenship Services (USCIS) kept announcing it has received enough within few days. Even this year, The duration will be more or less the same.

Just alike the previous years, Lottery System will be preferred to process H-1B Visa Applications for 2018-19. Whereas, More scrutiny will be done this time to ensure the applicant is specialized in a certain occupation. Application will be rejected if Employers fail to furnish legitimate business need to hire the foreign worker. A single company can't file multiple visa applications for the same foreign worker. There will be zero tolerance for even minor errors in the applications. Much higher rate of rejection of H-1B visa applications can be expected this year. Applicants who's visas were processed can work in US from October 1st this year and tenure will last for a maximum period of three years.

Spouses of H-1B visa holders who have H4 visa could neither work nor run a business until they obtain an Employment Authorisation Document (EAD). Only those who are on track to bag Green Card alone are eligible to apply for EAD.
