As expected, Karnataka Governor Vajubhai invited BS Yeddyurappa to form the government by proving majority within 15 days. This decision has been taken despite Congress and JD (S) have the majority to form the government collectively.

As a result, Congress moved Supreme Court at 2 am seeking orders to stop the Swearing-in Ceremony of BS Yeddyurappa. While BJP have 105 MLAs including one Independent, Congress and JD (S) have 115 MLAs (Magic Figure - 112 MLAs in 222-Member Assembly).

Describing the move of Karnataka Governor as 'encounter of the Constitution', Congress appealed Supreme Court Chief Justice Dipak Misra to intervene in the matter and cancel the first preference given to BJP.

Abhishek Manu Singhvi, who is the counsel for Congress-JD (S), argued that Governor gave license to poaching by inviting the party which doesn't have majority to form the government. He even found fault with 15 days time period as only 48 hours was given in such cases in the past.
