Since Governor invited BS Yeddyurappa to form the Government, Congress tried desperately to stop the Swearing-in Ceremony scheduled to happen at 9.30 am on Thursday. Abhishek Singhvi and other Lawyers moved House Motion petition in the Apex Court stating inviting BJP to form the Government inspite of falling short of magic figure is unconstitutional. They questioned, 'How could Governor ignore Congress-JD(S) which have 116 seats to form the Government and invite BJP?'.

Arguments which began in Supreme Court midnight lasted till Today morning. In the end, The 3-Member Bench made it clear that stay order can't be issued against the Swearing-in Ceremony of BS Yeddyurappa.

Apex Court maintained it can't stop Governor for using his powers. At the same time, Supreme Court gave another opportunity for Counsel of Congress-JD (S) to present fresh arguments instead of dismissing the petition. The Top Court informed BS Yeddyurappa's swearing-in ceremony on Thursday morning depending on the final judgement. Next hearing of the case will be at 10.30 am on Friday.
