In its report to the Union Government, The Law Commission recommended legalizing betting and gambling in India. The intention is to make the entire operation cashless with mandatory linkage of PAN and Aadhaar to prevent any wrongdoings. Upper Limit on the gambling amount could be based on the deposit, winnings and losses. Government Revenue can be boosted by levying Income Tax and GST on the money generated through gambling.
Law Panel opined inability of Government to impose a complete ban results in rampant increase in illegal gambling and black money generation/circulation. Regulating and making them taxable activities is the only solution.
Law Commission suggests division of gambling in two categories - 'Proper Gambling' & 'Small Gambling'. Only Individuals in high-income groups are permitted in the first category which allows high stakes. The second category is for low-income groups.
If Centre accepts the recommendations, It has to pass a legislation as per Articles 249 or 252 of the Constitution. If the legislation is under Article 252, States which aren't okay with legalizing betting and gambling will be free to do whatever they want.
