Curative Plea of Nirbhaya Convict Rejected

The curative petition filed by one of the four convicts in the Delhi gang-rape case Pawan Kumar Gupta was rejected by the five-judge bench of the Supreme Court. The apex court was hearing 'in-chamber' the curative plea filed by Pawan Kumar Gupta.

The five-judge bench led by Justice N V Ramana heard the plea just one day before the execution date that was previously announced by the court earlier. The bench also said that no case is made out for re-examining the conviction and the punishment of the convict

 

Pawan Kumar is the last convict is the infamous case to move the SC with his curative plea. All the remaining three convicts have already used their legal remedies. With the curative plea getting rejected Pawan is left with only filing a mercy petition before President Ram Nath Kovind.

Earlier the mercy petitions filed by the other three were dismissed following Ram Nath Kovind's statement that the convicts are not in a state to show any mercy on them.

In his curative plea, Pawan pleaded the court that as per the school records his age was 16 years and two months at the time of the offense and "the age has not been determined in accordance with the procedures laid down under the Juvenile Justice Act".

He even claimed that the information of his age was suppressed by the state throughout the case proceedings.
