Death Penalty For Child Rapists

Following the outrage over the rapes of minor girls and month-old babies in the country, Union Cabinet Today approved an ordinance permitting Courts to pronounce death penalty to those who are convicted of raping children under the age of 12 Years.

Based on the Ordinance, An Amendment would be made to the Indian Penal Code (IPC), The Code of Criminal Procedure (CrPC), The Evidence Act and The Protection of Children from Sexual Offences (POCSO) Act to bring the new provision so that child rapists will have no right to live.

The ordinance also increases the minimum punishment for convicts in the case related to the rape of women from 7 years to 10 years of rigorous imprisonment. When it comes to rape of a girl under the age of 16 years, Minimum punishment has been increased from 10 years to 20 years and it can be extendable to rest of the life.

Centre proposes setting up of new Fast Track Courts for speedy trial of rape cases in consultation with States, Union Territories and High Courts.

A Person accused of rape or gang-rape of a girl under 16 years can't obtain anticipatory bail.
