Gujarat HC to hear final hearing in liquor ban on Oct 12!

One of the largest cities in the country, Gujarat has been following strict liquor prohibition since decades. The liquor ban is followed so strictly that people coming from other states should show their travel tickets to get liquor.

The liquor ban in Gujarat became a topic to discuss as the decision was challenged at the High Court and the Court has agreed to hear the petition.

When the Gujarat state government tried to defend the liquor prohibition, the High Court rejected the government's arguments and postponed the next hearing to October 12.

Going into details, a petitioner has knocked on the doors of the High Court challenging the liquor ban saying that banning liquor hinders the Right to Privacy.

The Chief Justice Vikram Nath of Gujarat High Court led bench that comprises Justice Biren Vaishnav had refused the government's arguments and said the court will hear the final arguments in October.

To challenge the decades old liquor prohibition in Gujarat, the petition cited the violation of Right to Privacy in his sensational petition, which could be a game changer for Gujarat.

The petitioner has maintained that the prohibition is nothing but a violation as the government has no power to decide what a person should drink or eat inside their house.

Advocate General Kamal Trivedi who represented the Gujarat Government in the petition placed his arguments that such petitions should be filed with the Supreme Court. However, the bench said there is no such need and the petition was accepted for hearing.

For the unversed,the sale and prohibition of liquor in Gujarat is banned and has been in effect since decades. The Gujarat Prohibition Act, 1949 has been followed in Gujarat irrespective of the governments.

The act that calls for the prohibition of liquor came into existence in Gujarat in 1960 and the same is being continued to function. However, people from other states and foreign tourists can get liquor.

Back in 2016, the Gujarat Government had brought an ordinance to make some amendments for the existing ban so that the prohibition can be imposed a way more strictly.
