Dowry Case? No Immediate Arrest: SC

Supreme Court passed a ruling that arrests can't be made immediately after the Dowry Harassment Complaint was lodged. The Apex Court said preliminary inquiry is a must before making any arrest.

In view of misuse of Anti-Dowry Harassment Law, Supreme Court has issued the latest order. This particular Law was framed in 1983 to prevent Dowry Deaths in the country.

In 2014, The Top Court asked Law Ministry to make amendments to the Act upon receiving complaints about the misuse of the Law came to it's notice. Even Cops were asked to consider the 41-Point Check List it suggested before making an arrest.

In the latest order, A direction was given to set up Family Welfare Committees in every district and arrest should happen based on the report submitted to local magistrate after holding discussions with the couple & their parents. SC mentions Arrest should be made only if the committee is convinced that there is a foul play by Husband.
