President Ramnath Kovind signed the ordinance passed by the Union Cabinet to make Triple Talaq or Instant Divorce a punishable offence. Parliament has to clear this ordinance within six months period.
The Muslim Women (Protection of Rights on Marriage) Bill 2017 was passed in Lok Sabha. However, It was stalled in Rajya Sabha due to lack of sufficient majority for the NDA.
Once if the Law gets implemented, Muslim men opting for Triple Talaq will face jail term up to 3 years and fine as well. FIR will be lodged only if the complaint was filed by Victim or her Family. The Victim Wife will be entitled to receive maintenance for herself and children. A Compromise can be worked out if the wife is willing to resolve the issue amicably. Although it's a non-bailable offence, Court can grant bail to the accused after hearing the Victim Wife.
