The boldest yet move of the BJP has ensured that the contentious Article 370 is history now. The presidential gazette issued on Monday has removed Article 370 from India's constitution. From now on, all the Central laws would be applicable to Jammu and Kashmir too. The Constitution of India would be applicable in full in JK from now. What more, in a swift move, the Centre has divided the state into two. From now on Ladakh will be a union territory without an assembly, while Jammu and Kashmir would be a UT with an assembly.
Article 370 is an obnoxious provision that has for years challenged the sovereignty of India. It gave a special status to JK. Here is a lowdown on the ill effects of the Article 370:
-> The people of Jammu and Kashmir have a dual citizenship. They are citizens of both J and K and India. They have their own state flag. While five years is the duration of every assembly in the country, it is six years in Jammu and Kashmir. Also, insulting the national flag and national symbols of honour is not an offence in the state. These provisions have spawned anti-national sentiments in the Kashmir valley.
-> Similarly, Supreme Court orders are not applicable to Jammu Kashmir. So, Kashmir can reject the orders outright. Similarly if a Kashmiri girl marries an outsider, she will forefeit her rights of JK citizenship. If a Kashmiri girl marries a Pakistani, all her rights would be in tact. This makes identifying the foreigners very difficult in J and K. RTI and CAG are not applicable in Kashmir. Minority reservations and Panchayat reservations are not applicable in J and K.
-> Outsiders cannot have permanent constructions anywhere in Kashmir. All these have now become a thing of past now what with the presidential notification.
