The Goa branch of the Bombay High Court disapproved the 7-year jail sentence and Rs 10,000 fine warded by a trail court for an Accused who was accused of raping his partner upon giving false promise to marry her.
Two Casino Workers had a love affair in 2013. Accused Yogesh Palekar who is a Chef invited his Lover to home for introducing her to his Family. She stayed back for the night as his family wasn't at home. The Woman filed a rape complaint after her partner refused to marry her despite maintaining sexual relations. She maintained sexual intercourse was agreed by her only on the pretext of marriage.
Yogesh Palekar challenged the verdict of the trail court in High Court. HC took the consensual sex between the lovers on multiple occasions in his house and their deep love affair into consideration. Even the complainant had gone to the extent of withdrawing her complaint as her Partner was undergoing treatment for depression. She even offered financial help to him during the trail period. HC took note of all these aspects and opined the accused have no intention to exploit the complainant.
