The 5-Judge Bench of Supreme Court passed the judgement that Triple Talaq is unconstitutional and disapproved the age-old practice of Muslims based on 3:2 majority.
Apex Court opined Triple Talaq is a threat to fundamental rights of Muslim Women as it's a practice that ends Marriage without even offering a chance for reconciliation. While Justices Rohinton Nariman, Uday Lalit and Joseph Kurien said Triple Talaq is unconstitutional, Chief Justice JS Khehar and Justice Abdul Nazeer told the Muslim Practice is a fundamental right.
Justice Joseph Kurien made it clear Triple Talaq is neither recognized by Koran nor true in theology and hence it can't be protected under Right to Religion. Justices Nariman and Uday expressed similar views.
