YS Viveka Case: Can Transfer Change the Fate Of Investigation?

YS Sunitha, daughter of former MLA YS Vivekananda Reddy who has been fighting hard to make the case out of Andhra Pradesh got a big relief as the Supreme Court gave its nod for the transfer of the case out of the state. Hearing a petition, the Apex Court transferred the case to Telangana CBI.

For the past few months, Sunitha has been alleging that the case investigation is not going as expected. To back her claims Sunitha mentioned the instances where the accused in the case reportedly threatened the local police and investigating officers.

When she earlier moved the Supreme Court seeking directives to move the case out of Andhra Pradesh, the investigating agency Central Bureau of Investigation supported this. Putting a full stop to the suspense, the Supreme Court has now agreed to transfer the case to Telangana from Andhra Pradesh for a better probe into the sensational case.

 The bench of the Supreme Court comprising Justices MR Shah and MM Sundresh heard the petition and said yes to the transfer of the case. During the arguments, the bench made some interesting comments and said that Viveka's wife and daughter have the right to decide where the investigation should happen.

Citing Article 21, the bench said that a free trial is a right and if the trial cannot be fair then the confidence of the public in the system would be at stake which is not good.

"Under the circumstances, we are of the opinion that this is a case to transfer the trial and other investigation on larger conspiracy and destruction of evidence, by a State other than the State of Andhra Pradesh," the bench said.

Though the case investigation was transferred to Telangana from Andhra Pradesh, we have to wait and see if the guilty will be placed before bars or not. Sunitha alleges that big names were involved in the case. Earlier she raised her doubt about YS Avinash Reddy, MP of the Kadapa constituency.

YS Vivekananda Reddy was found dead at his residence. Initially, the case was given to the AP CID. But the CBI came into the picture with Sunitha seeking the same. She is hopeful that the case transfer would change the fate of the case.
