Chandrababu's Quash Petition Goes Before CJI!

All eyes were on the Supreme Court today to see what it would say. As per the schedule, it is slated to give the verdict on the Skill Development Scam involving Chandrababu Naidu. The Telugu Desam Party chief filed a quash petition in the Apex Court as the High Court denied the relief.

The two-judge bench comprising Justice Aniruddha Bose and Justice Bela M Trivedi heard the partition. The verdict was out which says that the ball is in the CJI court now. The bench referred the case to the CJI and he will take the call on this.

The two judges could not come to a common decision and gave different opinions. With this, the bench said that it would refer the petition to the Chief Justice of India.

While giving the verdict Justice Aniruddha Bose opined that the petition is valid and section 17 A applies here. However, Justice Trivedi has a contrasting opinion. As the two judges gave contrasting views the petition will be referred to the CJI and the ball is in his court now.

Justice Bose observed that permission would have been taken from the Governor before the inquiry in the case as Section 17 A applies in the case. Having said that the Justice observed the previous inquiry cannot be applied to the arrest.

Another judge on the bench Justice Bela M Trivedi opined that 17 -A won't apply in the case and the case cannot be quashed based on the amendment done in 2018. It applies to the case that happened after the law came into existence, the judge observed.
