Court's Serious Comments On Spouse Denying Sexual Relationship!

A sensational issue has reached a High Court involving a couple on their divorce. Hearing the petition, the High Court supported the verdict given by a family court. During the arguments, the Court made some key comments on the marriage and the sexual relationship between the spouses.

A wife moved the Delhi High Court challenging the verdict given by a family court granting divorce to a man. Not happy with the verdict, the wife knocked on the doors of the High Court to challenge it. However, she did not get relief in this matter. The husband was given relief.

Going into detail, a couple tied the knot back in 2004. Shortly after the marriage, the wife went back to her home and did not come back. Having waited for a long time, the husband moved a family court to seek a divorce citing cruelty towards him by her husband.

But the wife did not accept the verdict and approached the High Court. She filed a petition against the verdict. The bench of Delhi High Court led by Justice Suresh Kumar Kait said that a spouse denying a sexual relationship wilfully is cruelty.

Shedding light on the sexual bonding between the couple, the bench said that marriage without sex is a bane and the partner cannot have a bigger disappointment than the spouse denying a sexual relationship.

The bench went on to say that the marriage was not consummated and the wife filed a dowry harassment case with the Police, but there is no evidence for this. The husband in this case went through a tough time for many years. Listing out all these aspects, the bench said that the husband should be given divorce in the case.
