Wife Denying Consummation Is Mental Cruelty: High Court!

Due to various reasons, the divorce rates have been increasing in India. If we look at the overall picture, India has the lowest divorce rate in the world despite having the largest population. However, the divorce rate has been increasing in the country for the past few years as per a report.

While dealing with divorce cases, the Courts are giving various reasons which can be the grounds to grant a divorce. Yet again, a High Court made crucial comments dealing with a divorce case and granted divorce to the husband.

The Madhya Pradesh High Court made sensational comments and said that a wife saying no to a physical relationship with her husband can be seen as mental cruelty and on the same ground he can get a divorce. Having said that the husband was given a big relief.

Going into details, a couple from Madhya Pradesh tied the knot in 2006. Since then the wife has been denying the consummation of marriage. In the same year, the husband left India for job purpose. Having seen this the husband moved a trial court in 2014 to get a divorce. However, he did not get the relief.

With no relief at the trial court, the husband moved the Madhya Pradesh High Court. The bench of the Court comprising Justices Sheel Nagu and Vinay Saraf heard the petition and said that the wife denying consummation is mental cruelty and the husband can be given divorce. The bench of the High Court quashed the orders issued by the trial court and granted divorce to the husband.
