Kajal Faces Defeat In Court Battle
By: Tupaki Desk | 27 Jun 2018 3:40 AM GMTKajal Agarwal received a huge setback in the case related to Advertisement Royalty. Madras High Court upheld the decision of the lower court and turned down the plea of the Actress seeking compensation for using Ads featuring her beyond one year agreement period.
A Division Bench comprising of Justice MM Sundresh and Justice Anand Venkatesh refused to issue an order restricting coconut oil manufacturer VVD & Sons Pvt Ltd from using her promotional material. High Court maintained VVD & Sons Pvt Ltd is the first owner of the advertisement featuring Kajal. Any first owner of the copyright will have a statutory right over it for a period of 60 years under Section 26 of the Copyright Act. Hence, Using the content can't be restricted for a period of one year just based on agreement.
Responding on the compensation sought by Kajal, The Bench clarified she can't deny the right of a Producer once after offering her consent. Petition moved by the Top Heroine has been dismissed.
