Ap Hc Directs SEC To Not Start Any Sort Of Probe Into Unanimous Poll
By: Tupaki Desk | 20 Feb 2021 6:41 AM GMTThe Andhra Pradesh High Court heard a bunch of petitions filed challenging the directives issued by State Election Commission (SEC) to the collectors and district election authorities on unanimous poll.
Justice DVSS Somayajulu issued interim orders on SEC's directions and directed the electoral body to not start an inquiry into the unanimous polls where the candidates were elected unanimously in Municipal elections last year after issuing Form-10
The High Court directed the SEC to not issue any orders in regard to the MPTC and ZPTC wins on the grounds of non-issuance of Form-10 till the 23rd of February. The next hearing was adjourned to February 22.
Candidates who were declared unanimous in the Municipal polls have knocked on the doors of the High Court challenging the orders issued by the State Election Commission(SEC)
During the arguments, justice Somayajulu said the SEC cannot interfere if the candidate was elected unanimously. There is no scope for the SEC to interfere in the issue going by a few complaints.
The lawyers who represented the petitioners told the court that the election process for MPTCs and ZPTCs was held last year and orders directing the authorities to submit a report on the polls should be seen as illegal.
"How can the SEC call for an inquiry after the election result was announced?. What is the need of issuing orders for a report on February 18 and asking the authorities to submit the report by February 20," the Judge asked
