Here comes a good news for Indians who wish to obtain Permanent Residency in United States. Today, The US House of Representatives will be passing a legislation that ends the country-cap on Green Cards.
The Fairness for High-Skilled Immigrants Act, also known as HR 1044, is likely to be passed with over 310 out of 435 US Lawmakers, both Republicans & Democrats, supporting it. As many as 203 Democrats and 108 Republicans have been co-sponsoring the bill. 290 Votes will be required to pass a bill without hearing and amendments. With the support of over 310 Members, The legislation proposing the end of country-cap on Green Cards might be cleared without any hurdles.
India is worst hit by the Per-Country Cap on Green Card. The wait period for Indians on H-1B Visas to obtain Green Card is over 70 years because of this rule. The Fairness for High-Skilled Immigrants Act not only ends the 7 percent cap for Employment-based Immigrant Visas but also increases the Per-Country Cap on Family-Based Immigrant Visas from 7 percent to 15 percent. Coming to unreserved Visas, More than 85 percent can be allotted to Immigrants from one particular country.
The New Bill changes the norm that reduced the count of Visas issued to Chinese Citizens. It also leads to tradition rules for Employment-based Visas from Financial Year 2020-2022 by reserving a percentage of EB-2 (Those with Advanced Degree or Exceptional Ability), EB-3 (Skilled Workers) and EB-5 (Investors) Visas for Individuals from other than the two countries with highest number of visa recipients.
