Denying Sex to Husband leads to Divorce

The bench passed this verdict during the hearing of a divorce petition filed by a Man complaining his wife has subjected him to mental cruelty by avoiding physical relationship for the past 4-and-a-half years despite staying healthy. Based on the fact that wife hasn't denied the allegation leveled by her hubby in the trail court, High Court granted divorce to him.
Justices Pradeep Nandrajog and Pratibha Rani told: 'Husband has been subjected to mental cruelty by denying sex for long time inspite of living under the same roof'.
In March this year, A Trail Court has dismissed the divorce petition of the Husband on grounds that the issue raised by him doesn't meet the standard of cruelty according to the provisions of the Hindu Marriage Act, 1955. The husband challenged the trail court order in High Court and received a favorable decision.
