Employment Act Won't Support Moonlighting: Minister!
By: Tupaki Desk | 19 Dec 2022 1:09 PM GMTA Union Minister gave a big blow to the IT employees by supporting the version of the employers as far as the Moonlighting policy is considered by saying that as per the law employee cannot do any work or job which goes against the interests of the employer.
Amid big companies laying off employees for participating in moonlighting policy, the issue was raised in the Parliament house. In a written reply, the concerned Minister said that the law will not permit employees to take part in the Moonlighting policy and hold two jobs.
When asked about the government's response to whether it thinks Moonlighting policy has anything to do with the employers firing employees, Minister of State for Labour & Employment Rameshwar Teli gave his reply in return.
Citing the Industrial Employment (Standing Orders) Act 1946, the Minister said that employees cannot take up any kind of work that goes against the interests of the employers who are giving them employment. Employees can't take up any opportunity more than his/her job, he said.
Saying that the government has not taken up any study to know if the moonlighting policy is playing any role in the layoffs of the employees, the Minister said that laying off employees is a very common practice in the sector and there is no specific reason behind this.
The IT employees are already not happy with the employers as they are very strict on their stand on the no moonlighting policy. With the Minister saying that the law also doesn't permit this the employers can show it as an example to remove them from the jobs.
