The Punjab and Haryana High Court gave a remarkable judgement in the matter related to consensual sex with a girl who is below 16 years of age. These days, The Accused have been taking advantage of the laws on grounds that the sex was consensual with the Teenager. Now, HC makes it clear any such sexual act with a teen could be treated as a crime.
Justice Anita Chaudhary opined there is every possibility of a minor girl getting lured by the accused for a sexual act without being unaware of the consequences. From now, Men can't take advantage of the consent given by the opposite sex who's age is below 16.
The Court ruled the male partner will be treated as a criminal if the girl is below 16 years and he can't claim the sexual act was consensual.
