Rajya Sabha Chairman Hamid Ansari gave permission to the Central Bureau of Investigation (CBI) to prosecute a MP. The sanction has been given under section 197 of the CrPC (Code of Criminal Procedure), which is a pre-requisite for the prosecution of a public servant.

It was the first time in the history of Rajya Sabha to give consent for a prosecution of MP.

The prosecution sanction was given against JDU MP Anil Sahani, who has been named by the CBI in an LTC scam. CBI had filed a charge sheet against the MP alleging that he along with some other persons conspired to defraud Rajya Sabha to the tune of Rs 23.71 lakh

The investigation agency alleged that the MP used forged e-tickets and fake boarding passes to defraud the house. He showed the amount as travel and dearness allowance without undertaking the actual journey

The Bihar MP is reportedly the first from the Elders' House who will be prosecuted by CBI after sanction in this regard was given by the Chairman. While this is a first for the Rajya Sabha, such sanction has been given only twice earlier in the Lok Sabha. Way back in 2010 Speaker Meira Kumar gave sanction against Congress MP Rajaram Pal in the cash-for-query scam. A year later, she gave a sanction to Delhi Police against BJP MP Ashok Argal in the cash-for-vote case.

Meanwhile Sahani, a second time MP, had claimed that it was a political conspiracy by BJP government to malign him. Sahani term will come to end on April 2018. Anup Singh Panwar, an employee of Delhi-based Air Cruise Travels Private Limited, N S Nair, then Office Superintendent (Traffic), Air India and one Arvind Tiwari were also included in the charge sheet.
