The United States citizenship and immigration services (USCIS) introduced a new policy to act tough on International Students overstaying in the country. While the Students found to be guilty of unlawful presence for over 180 days will be barred from reentry into US for 3 years, Those Individuals who overstayed for more than a year will be barred for 10 years. This new policy not only affects the International Students but also their dependents such as Spouses & Children.

Several Colleges filed a lawsuit challenging the new policy of USCIS. A US District Court issued a preliminary injunction which doesn't permit USCIS from implementing the policy for unlawful presence.

Around 2 Lakh Indian Students in USA will breath a sigh of relief after the court order. The New Policy of USCIS is such that a Student could be barred from re-entry into US for 3 years or 10 years if he/she violates the student status unknowingly and that's been discovered after many years. Such a harsh rule could ruin the immigration practice which remained consistent for decades.
