Markandey Katju: 'In Democracy, People are supreme and State Authorities are their servants. Hence, people have a right to criticize the state authorities, including the legislature, the Ministers and the officials. This right has also been guaranteed by Article 19(1)(a) of the Constitution'.
The Judge recalled the arrest of Jadavpur Univerity Prof.Ambika Mahapatra for criticizing West Bengal CM Mamata Banerjee in the form of cartoons on this occasion. He described AP Chandrababu Naidu, who is behind the arrest of Ravi Kiran, as a tinpot dictator & paper king.
Mr. Katju warned AP Police for following such unconstitutional orders by quoting an example. After the World War 2 in Germany, Nazi War Criminals claimed they just followed the orders of their Master Hitler. But still, Their argument was ignored and most of them were hanged. Quoting this example, He advised Police not to follow the orders of Minister or their Superiors blindly.
