Nirbhaya Case Deferred To March 5 By The Supreme Court

In a shocking turn of events, the Supreme Court has deferred the hearing of an appeal that was filed by the Centre seeking permission to execute the death sentence of the convicts in the Nirbhaya case separately.
At the beginning of the session, the three-judge Bench headed by Justice R. Banumathi was informed that earlier trial court has fixed the execution of all the four convicts for March 3 at 6 a.m.
Reportedly out of the four convicts only Pawan Gupta has the legal remedies as the other three convicts were left with no remedies to use. He has not filed a curative petition in the apex court. Even he did not file the mercy petition with the President.
Solicitor General Tushar Mehta who has been very critical on the convicts who never left any stones unturned to make get the benefit of the legal remedies said that these convicts are testing the patience of the nation.
"This case is of 2012 and I am still struggling to execute the death sentence. They are acting in tandem to misuse the law by filing one petition after the other... People will stop having faith in the judicial system. Seven years have gone by and the convicts are still playing (with) the judicial system...It is in situations like this that people celebrate encounter killings," Mr. Mehta submitted in his plea filed on February 17.
Recently Vinay Sharma, one of the four convicts has fractured his right arm and said that he was suffering from "insanity", 'mental illness" and "schizophrenia". His plea was rejected by the court after the psychologists who appeared on behalf of the jail said that the medical reports state that all of them are fine.
