States should not say no to Covid compensation: Supreme Court

India’s top court Supreme Court had once again made it clear that the competition for Covid victims cannot be stopped and said the ex-gratia for the kin of the victims should be given even though they won’t produce any certificate confirming the cause of the death as Covid.

Hearing a petition on Monday that sought directives from the Apex Court, the Court that the families of the Covid victims should be given a sum of Rs 50,000 as compensation and the amount is in addition to the amount paid by the government.

Justice MR Shah who heard the petition said that the states cannot deny the compensation saying that the death was not caused by the Coronavirus. The authorities at the district level to check the death cause and the details gathered by the commission should appear in print media, the Justice said.

During the arguments, the Justice said that the amount that goes to the compensation payment should be given from the Disaster relief funds of the respective states. In less than one month of the compensation application, the amount should reach the families, the Supreme Court said.

Making the process of retrying the death cause, the Apex Court said that the grievance committee will decide on the compensation in less than 30 days from the date of application filing. To get more details on the cause of death cause, the concerned officials possess the power to call for the medical records to come to a conclusion, the court maintained.

While hearing the petition, the Supreme Court had also given its nod to the recommendations of the National Disaster Management Authority (NDMA) on the compensation that Rs 50,000 should be given for the kin of the Covid victims.

Besides agreeing to the recommendations, the Supreme Court issued directives to the Central and State governments that the information on the compensation payments should be widely publicized so that people will know about it.

The Apex Court also added that the family members of the victims, who lost their lives battling the Covid can reach the concerned departments to make any required changes in the death certificates that were issued already.
