High Drama in Supreme Court At Midnight

Why did Governor invite BJP to form Government after 10 PM? 10 AM to 9.30 PM are the Working Hours of Supreme Court. Anticipating much in advance that Congress and JD (S) could move Supreme Court against the Swearing-In Ceremony, Governor might have issued the letter at around 10 PM. Even BJP planned to wrap up the swearing-in ceremony before the Supreme Court starts functioning on Thursday.
Congress prepared a plan to launch counter attack. Before the news of Governor inviting BJP to form the Government became public, The National Party decided to move a House Motion in the Apex Court. Team of Lawyers led by Abhishek Singhvi reached Supreme Court within minutes after Governor invited Yeddyurappa to form the government. A House Motion Petition was moved at 11.47 pm. They went to the residence of Chief Justice at 12.28 AM for obtaining a stay of swearing-in ceremony.
Chief Justice agreed to hear the arguments only after Lawyers complained about the violation of the Constitution by Governor. The case was handed over to a 3-member Bench and Court No.6 was allotted for the proceedings at 1.45 am. Chief Justice directed the Lawyers to submit their arguments in the writing. Soon, Abhishek Sighvi submitted the written statement accusing Governor of ignoring the judgement given by Justice Sabarwal in Rameswar Prasad case. He questioned why did Governor ask BJP to form the government despite lack of majority. Though BJP have an upper hand, Congress managed to open the doors of Supreme Court at midnight.
