The Supreme Court which heard a petition seeking the transfer of funds from the (PM CARES) to the National Disaster Response Fund(NDRF) quashed the petition and said the funds cannot be transferred.

The three-judge Constitution bench led by Justice Ashok Bhushan maintained that PM CARES and NDRF can separately exist and said PM CARES is not the violation of the Disaster Management Act (DM Act) of 2005.

The case reached the Supreme Court after Centre for Public Interest Litigation (CPIL), an NGO knocked on the doors of the apex court and said teh set up of PM CARES is a violation of the Disaster Management Act.

The NGO told the Supreme Court that as per the Disaster Management Act, the contribution made by individuals or institutes towards disaster management should be credited to NDRF.

However, the Supreme Court refused to issue orders to transfer the PM CARES Funds to NDRF and ana said the new plan made by the government can deal with the pandemic.

Prime Minister's Citizen Assistance and Relief in Emergency Situations Fund(PM FUNDS) was started by the Centre led by Prime Minister Narendra Modi as a bid to deal with the emergencies.

Bharatiya Janata Party(BJP) leaders hailed the verdict of the Supreme Court on the PM CARES and lashed out at Congress party and party leaders who have been targeting PM CARES recently.
