Department of Consumers Affairs made it clear Eateries levying Service Charge is an illegal act. Customers were advised to move Consumer Courts if they found hotels and restaurants seeking service charges.

In April this year, Department of Consumers Affairs passed an order prohibiting Eateries from levying Service Charges. Customer was given the right to choose whether he has to pay service charge (tip) or not depending on the quality of service.

Consumers Affairs Secretary Avinash K Shrivastava asks Consumers to approach Consumer Court if they found any hotel or restaurant violating the rule. He also invited customers to approach the Department of Consumers Affairs for guidance on preventing any kind of violation.

However, National Restaurant Association of India Secretary General says levying Service Charge doesn't come under violation. He went on to say guidelines can't be treated as a law.
