United States Citizenship and Immigration Services (USCIS) can't reject a H-1B Visa Application without giving an opportunity for the applicant to provide more evidence to prove the case. An Immigration Official can't reject the application without a Request for Evidence (RFE) if sufficient evidence is missing.

Whereas, The revised policy issued on July 13th allows Officials to reject the applications outright if the required initial evidence wasn't provided or if the applicant failed to establish eligibility for the visa sought.

Due to the change in policy, Companies seeking H-1B Visas for their employees mayn't be allowed to submit documentary evidence in the second attempt to prove the eligibility. Some of the employees could be facing the risk of deportation in such cases.

The revised policy will come into effect from September 2018 onwards. H-1B Visa seekers need to more careful from now as they won't have a second chance.
