Who is Arya Samaj to Issue a Marriage Certificate asks SC!
By: Tupaki Desk | 3 Jun 2022 11:42 AM GMTThe Arya Samaj system is a game-changer as far as marriages are concerned. Without the Arya Samajs, most of the love marriages in India would have not happened. Though the system was started by sannyasi Dayanand Saraswati on 7 April 1875 for the social reforms, it has been making wonders for the lovers.
The Arya Samaj has been in the news as a petition was filed with the court questioning the credibility of the marriage certificates issued by them. The issue then reached the country’s top court, the Supreme Court.
In a big judgment, the Supreme Court said that Arya Samaj holds no legal jurisdiction to issue a marriage certificate. The Court said that issuing marriage certificates is the work of Arya Samaj and the prescribed bodies will take care of issuing the certificates.
The question of the credibility of the Arya Samaj marriage certificates was raised after the parents of a girl filed a petition against a boy accusing him of kidnapping their daughter. They also said that despite being a minor, their daughter got married.
The Allahabad Court heard a petition on this and said that a detailed investigation should be done on how the Arya Samaj is issuing marriage certificates. Later, the issue was taken to the notice of the Supreme Court.
Hearing the petition, the bench of the Supreme Court comprising justices Ajay Rastogi and BV Nagarathna said that Arya Samaj is not the right institution to issue the marriage certificates.
