Huge setback for Hindu Wives in India
By: Tupaki Desk | 8 Oct 2016 9:36 AM GMTSupreme Court maintains Hindu Husband could sought Divorce from Wife who is trying to forcibly separate him from his parents/family.
Justice Anil R Dave and Justice L Nageshwara Rao delivered this historic verdict during the hearing of Divorce petition filed by Karnataka-based Man. 'In a Hindu society, Sons have the obligation to take care of their Parents. If a wife of a Hindu Man disapproves this normal practice then, there should be a specific reason behind it. But, We don't find any such justifiable reason in this case. No Husband would tolerate if he was asked to separate from his Parents or Family Members who are dependent on him,' the Bench opined.
The Apex Court further adds, Pressure from Wife on Husband to separate from his family could be torturous to the life partner and its treated as an act of cruelty. Husband could seek divorce on such grounds as might be facing torture and lacks peace of mind.
Actually, A lower court granted Husband divorce after he complained about wife's cruelty. He, however, received a setback with the High Court quashing the lower court's order. Finally, The Man approached Supreme Court and got what he wanted.
The verdict in the case of Karnataka-based Couple who marries in 1992 came as a huge shock of Hindu Wives. It has given scope for a serious debate!
