The desperation for the Indian student community to somehow stay in the United States is starting to have negative consequences. A rising number of international students on F-1 visas in the United States are confronting serious immigration risks after being laid off during their Optional Practical Training (OPT) or STEM-OPT period.

At the heart of the issue is a strict rule that limits unemployment during OPT once students stay back too many days without valid employment, they risk losing their legal status.

In one reported case, a STEM-OPT student in New York had already used 30 of the allowed 150 unemployment days and now has about 120 days left to secure qualifying employment or face visa complications.

The pressure is compounded by a competitive job market and changing immigration enforcement dynamics. Students are scrambling to find roles that align with OPT regulations, with many targeting fields such as data science and AI that match their studies and offer compliant employment opportunities.

Some are exploring options like consulting firms or part-time roles with small businesses, but these come with heightened scrutiny and potential pitfalls if not properly structured.

Experts warn that maintaining SEVIS compliance and avoiding sketchy employment arrangements is critical, as violations could not only end work authorisation but also jeopardise future visa applications.

As layoffs continue and the job market remains tough, the F-1 OPT unemployment clock is now a ticking deadline for many students striving to balance career ambitions with strict visa rules.
