Pay Maintenance To Ex-Spouse: HC Tells A Woman!

Whenever a couple gets divorced, the man is directed to pay alimony or maintenance. This is common in many cases. If a woman is unemployed she gets the maintenance. But everyone is talking about a case in which the Court gave a sensational verdict by directing a woman to pay monthly maintenance to her ex-husband.

The man in the case is unemployed and has health issues. Highlighting the same, the High Court directed the woman to pay Rs 10,000 every month. By saying so the High Court of Bombay upheld the orders given by a lower court.

Going into details there is a couple in Maharashtra that filed for a divorce a few years back. A family court granted the divorce and directed the woman to pay Rs 10,000 per month. The woman moved the High Court challenging the family court’s orders.

The High upheld the lower court’s orders and directed the woman to pay Rs 10,000 to her ex-husband. During the arguments, the woman told the court that she had resigned as a bank employee. To this, the Court asked how the money is taking care of two children if there is no income.

The media reports say that the bench said that Section 24 of the Hindu Marriage uses the term Spouse which applies for husband and wife too. If they are in a position to not take care of themselves they either husband or wife can apply for the maintenance, the bench said.

Talking about the ex-husband in the case he works at a private company. But he is unable to go to the office due to his condition which needs good care. Understanding this, the Bombay High Court ordered the woman to pay compensation to her ex-husband.
