A recent case in Florida shows how problems from the past can return during a green card interview.
A couple went for their marriage-based green card interview, expecting it to be routine. However, the officer brought up an old application from a previous marriage. That earlier case had been denied years ago on suspicion of fraud, even though no fraud was ever proven.
Because of this history, the new application was not treated smoothly. The officer raised doubts, and the couple faced delays and stress. Many immigrants experience the same issue, where unproven concerns from the past create obstacles for present applications.
By law, genuine marriages should not be punished because of past suspected sham marriages. Section 204(c) of the Immigration and Nationality Act protects such cases. But in reality, officers sometimes depend on their own judgment, and past records can still create problems.
Experts suggest couples in this situation should gather all their past immigration records, prepare strong evidence to prove their marriage is real, and take the help of an experienced immigration lawyer.
This issue has become even more serious since August 2025, when USCIS announced stricter rules and deeper checks for all marriage-based green card cases.
