The United States judicial system is extremely tough and hard to crack for immigration population and this is on display as we look at the case of an Indian man who had to spend 43 years in jail in the US.

After an extraordinary legal battle, an Indian-born man who spent 43 years in a U.S. prison for a murder he did not commit has won a major reprieve and been ruled eligible to remain in the United States.

An immigration judge recently decided that Subu Vedam, a Green Card holder who was wrongfully convicted in 1982, can now stay in the country despite efforts by federal authorities to deport him.

Vedam’s conviction for the 1980 death of his friend was overturned last year, and prosecutors dismissed the charge after new evidence emerged showing serious flaws in the original case.

However, shortly after his release in October 2025, U.S. Immigration and Customs Enforcement (ICE) took him into custody and sought to deport him based on an old deportation order tied to an unrelated conviction from decades earlier.

In her ruling, the immigration judge noted Vedam’s personal growth during his long years of incarceration including his academic achievements and mentoring of fellow inmates and acknowledged the unfairness of punishing someone who was ultimately cleared of the crime.

The Department of Homeland Security has been given time until May 4 to decide whether it will appeal the judge’s decision. Meanwhile, Vedam remains in ICE custody as the legal process continues.
