H1B Exemption: Good News Or Bad News For Indians?
Earlier there was this exemption for the Indian community to apply for green card from the comfort of the United States, without having to leave the country.
By: Tupaki Desk | 28 May 2026 12:24 PM ISTIt is already known that the United States immigration authorities have been making certain changes to the immigration policies that have been affecting the international immigration population.
The most recent modification came in the form of the alteration of H1B2 Green card conversion. Earlier there was this exemption for the Indian community to apply for green card from the comfort of the United States, without having to leave the country.
However, the new regulation is that anyone who is applying for permanent residency in the United States must go back to the origin country, unless there is an extraordinary circumstance. This is a significant to the Indian community as they are now mandate to go back to India before applying for the green card.
But in what could be considered a mild positive update, the United States authorities have started to issue a new regulation which provides a minor exemption to the Indian community.
In a new statement, U.S. Citizenship and Immigration Services spokesman Zach Kahler suggests that green card applicants in the U.S. who will provide an economic benefit or serve the national interest will be allowed to complete their processing here without having to leave.
But the main aspect here is that the largest section of the Indian community does not fall into either of the brackets of national interest or economic benefit to the United States. So this exemption might be very limited in nature, and there might not be too many beneficiaries from the same.
