US Visa Same Day Approval: What’s Up?

The United States immigration authorities have largely amplifier their immigration policies in the recent past and things are not looking very good for the Indian population yet.

A rare and confusing situation has recently surfaced for some US visa applicants after both their H1B work visa and H4 dependent visa were approved on the same day by USCIS.

This has raised concerns about which visa status is considered valid and when the transition officially takes place.In the reported case, the individual initially applied for an H4 visa after losing their job in order to remain legally in the United States.

Shortly after, they secured a new employment offer, prompting the employer to file an H1B petition under premium processing. Unexpectedly, USCIS approved both petitions on the same date, leaving the applicant uncertain about their lawful status.

Immigration specialists clarify that visa status is determined by intent and action. Until the individual begins working for the new employer, they are considered to be in H4 status. Once employment starts, the H1B status automatically becomes active and overrides the H4 classification. The most reliable way to confirm the correct status is by reviewing the I94 record attached to the H1B approval notice.

Experts advise applicants in such situations to closely coordinate with their employer and legal counsel to ensure compliance and avoid future complications related to employment authorization or travel.
