The Supreme Court will hear the plea which was filed against the verdict of the Delhi High Court against the stay on the execution of the convicts in the brutal gangrape and murder of Nirbhaya.

The constitution bench led by Justice R Bhanumathi said that directing the convicts to exhaust all the remedies within the given deadline will harm their civil rights.

Solicitor General Tushar Mehta said that by delaying the execution process the "nation's patience is being tested" in the case.

Talking about the mercy petition filed by the convicts, Mr. Mehta said, "Pawan has chosen not to file a curative or a mercy petition. The question is, is the authority required to wait endlessly."

"Issuance of notice will not harm them. The high court had also issued notices to them. The court can have the benefit of their assistance on the issue. As an institution we are answerable to the society," he added.

Mehta said the bench that they have to lay down the law on the grounds of whether the convicts in the same case can be executed separately or not.

After the bench said that it would hear the next hearing on Feb 11, Mehta requested the apex court to issue a death sentence to all the four convicts in the case.
