Can Congress governments refuse to implement CAA?

In a significant setback to the Congress and the other Opposition parties, two prominent Congress leaders, who are also legal luminaries, have warned against the state governments saying No to a law passed by the Government. Kapil Sibal said that the state governments have to obey something that is there in the constitution otherwise there would be consequences. He was referring to the implementation of the Citizenship Amendment Act (CAA).  Another legal luminary, Salman Khursheed, who was former law minister at the Centre, said that the CAA will remain in the law book as long as the Supreme Court does not strike it off. Speaking at the Kerala Literature Festival in Kozikkode, he said a state cannot say No to a law cleared by Parliament. "If something is on the statute book, you have to obey the law, else there are consequences," he said. So, we should wait for the final pronouncement to be made by the Supreme Court.

Kapil sibal also said that all must stand together and should not score political points. When the CAA is passed, no state can say "I would not implement it.," he said.
