Public interest litigation (PIL) plays a big role in judicial activism. Anyone can move the Court with the PIL on issues that deal with public interests. But the PILs are misused sometimes and the petitioners have to face the wrath of the courts. Another example joined the row with a former Parliamentarian getting slammed by the Court.
Senior politician Chegondi Harirama Jogaiah is one of the senior politicians in Andhra Pradesh. He earlier served as a Lok Sabha member and after his retirement, he is focusing on the Kapu movement and he has been a strong supporter of the fight.
The former Home Minister faced the wrath of the High Court over his PIL. In his petition, he sought an early probe in cases faced by Andhra Pradesh Chief Minister YS Jagan Mohan Reddy. In his petition, he sought directives from the Court to CBI to complete the cases before the 2024 elections.
The High Court registry raised objections to Chegondi Harirama Jogaiah's PIL. The PIL was taken to the notice of the High Court bench led by Chief Justice Ujjal Bhuyan and Justice N. Tukaram. During the arguments, the bench expressed his dissatisfaction and asked what public interest the petition carries.
Asking if the petition was filed for Promotional purposes, the High Court bench asked if the petitioner approached the investigating agency for a faster probe or went to the CBI to issue the concerned directives to the PP.
Media reports say that the High Court slammed PIL and called it a Public Nuisance. Saying that there is no public interest in the petition, the bench asked if the PIL was filed with vested interests. Stressing the fact that Chegondi Harirama Jogaiah is a former MP, the bench reportedly said âAs a responsible former MP, behaving like this is not appreciable. At least you think there is a public interest in the petition you filed. Please don't come to court for personal interests and waste our timeâ.
Lawyer representing Chegondi Harirama Jogaiah told the bench that the petition that was filed has the eligibility to get heard and they will argue on the merits if time was given. The bench postponed the petition to the 6th of July.
