HC's Key Orders On Govt Staff Facing Cases!

A government job is everyone's dream and everyone cannot bag it. It takes a lot of preparation and aspirants have to go through a few stages. Background check is another key aspect and people facing cases will not get a government job. If such cases are found the employer will not select the employees for the jobs.

Now the latest judgement given by the High Court of Andhra Pradesh said that the cases will impact the promotions of job holders as well. Hearing a petition, the court said that government staff with criminal cases pending against them are eligible for promotions only after the cases are cleared. The Court also said that the stay orders cannot be the ground for promotions.

Going into details, a woman named Nagarani is working as a constable in Andhra Pradesh. She is facing criminal charges of using fake certificates. Her increment was also stopped and a lower court gave a verdict directing her to serve three months in jail. She moved the High Court seeking directions for her promotion.

Hearing the petition, Justice Nimmagadda Venkateswarlu said that government staff are not eligible for promotion unless the charges are cleared. He also said that the staff can get promotions showing the stays issued by the High Court as the ground.

The justice also mentioned GO 66 while giving the verdict which was issued in 1991 and grants power to the government to postpone staff promotions if they are criminal charges and inter-departmental disciplinary proceedings.

The case of Nagarani falls under inter-departmental disciplinary proceedings. She was appointed as the junior assistant in AP Special Police. As her father YV Rangaiah passed away due to a heart attack, she was given a temporary job. She was asked to complete intermediate and was given a certain time.

In 2001, she submitted her certificates. When the department sent the certificates for verification, they were found fake. On the same ground, she was suspended and her increment was also postponed. Though her suspension was revoked, her increment was stopped. Nagarani approached the High Court to challenge the verdict of the Principal Sessions Judge court.
