A husband who hails from God's own country Kerala has moved the High Court challenging the verdict given by a family court granting divorce to them.
Hearing the case, the division bench of the High Court comprising A Muhamed Mustaque and Justice Kauser Edappagath has made some key comments.
The bench said, having sex with wife when he is not interested comes under martial rape and called it a form of cruelty.
Having said that, the bench said a woman can seek divorce from her spouse on the same grounds.
The bench said, wife and husband are equal in marriage and no one should think they are superior to others.
During the arguments, the bench also observed that his husband cannot see her wife as a money making machine.
The victim allegedly said that her husband forced her to have sex despite saying she was not interested. Even when she was sick, she was not spared.
