Supreme Court's Intense Comments On Maha Political Crisis!

Update: 2023-05-11 16:03 GMT
Everyone knows what happened in the Maharashtra politics. The strong Hindutva party Shiv Sena faced a big blow with the rebels withdrawing their support to the party. Under dramatic turns of events, the government was changed and the Shiv Sena party was divided into two parts. The Eknath Shinde-led faction of Shiv Sena is ruling the state with the help of the Bharatiya Janata Party.

Uddhav Thackeray and the Shiv Sena (UBT) have been fighting for the disqualifications of 16 MLAs including Maharashtra Chief Minister Eknath Shinde. Now the Supreme Court made some sensational comments on the Maharashtra political crisis and also expressed some objections.

The Apex Court said that Uddhav Thackeray cannot be reinstalled as the Chief Minister of Maharashtra as he resigned from the post. The Supreme Court is also said to have observed that Uddhav Thackeray should have not stepped down from the position.

However, the Supreme Court gave a big relief for the Eknath Shinde camp as it allowed him to continue as the Chief Minister. But said it is illegal to appoint a Whip as only the head of the party holds the power to appoint the whip of the party. Appointing Gogawale as the Whip was illegal.

During the hearing, the Supreme Court also found fault with former Maharashtra Governor Bhagat Singh Koshyari who was in office during the political crisis. The bench observed that the Governor calling for the floor test was not under the law and this led to the toppling of the government.

What the court said is right. If not for the floor test orders by the Government, the Maha Vikas Aghadi government would have not toppled. As a few MLAs became rebels Uddhav Thackeray did not go for the floor test and resigned from the post. People like Sharad Pawar also did not like this. He said that Uddhav Thackeray would have put a fighting force on the issue.

A few MLAs led by Eknath Shinde became rebels and started troubling the alliance government. They approached the BJP, which is the single largest party in the state, and formed the government. Though it was predicted that Devendra Fadnavis would be made the CM, Eknath Shinde became the CM of Maharashtra and Devendra Fadnavis became his deputy.
