Supreme Court issued an apology to a Woman for 13-year delay in a forgery case.
In 2004, Shyam Lata who is a resident of Roorkee in Uttarakhand lodged a complaint with the SSP of Haridwar accusing her two brothers of claiming ownership of her shop using forged documents and signatures. A criminal case was booked against the two brothers. Whereas, One of the brothers moved a Civil Suit to prevent his eviction from the shop. Two contrast verdicts delivered by the High Court on the same day in connection with two petitions related to the case has led to over a decade long delay in judgement. While it favoured further investigation in the first order, Permission was denied for any further probe in the second order.
The case has reached Supreme Court in 2009. But now, Complainant is no more alive to claim victory due to the delay in the judgement.
Justices RK Agarwal and Sanjay Kishan Kaul felt sorry because the confusion over High Court's two different orders delayed the proceedings by a decade.
