Green Card Holders Safe, Others Affected by Trump’s Executive Order

But the only people unaffected by this order are Green Card holders in the Indian community.

When Donald Trump became president of the United States, he signed several executive orders. One of these orders directly impacted the Indian community with regards to visas. Trump ended birthright citizenship which meant that a child born in the U.S. would no longer automatically get U.S. citizenship if the parents were on certain types of visas. This change will take effect on February 19, 2025.

But the only people unaffected by this order are Green Card holders in the Indian community. Other visa holders will see a change in the rules regarding their children’s citizenship status.

The new rules are as follows:

If both parents have Green Cards then the child will get U.S. citizenship.

If the mother is on an H-1B visa and the father has a Green Card then the child will also get U.S. citizenship. But if both parents are on H-1B visas then the child will not get U.S. citizenship. The same is true if the father is on an H-1B visa and the mother has an H-4 dependent visa or if the father is on an H-1B visa and the mother is on a visiting visa.

Lastly, if both parents are on student visas the the child will not receive U.S. citizenship.

These changes will affect many people in the Indian community. Only Green Card holders are unaffected by this executive order. People on other types of visas will need to adjust to these new rules.
