Sexual Act With Wife Below 18 To Consider As Rape!

The ruling Bharatiya Janata Party made the best out of the Monsoon Parliament sessions. The party not only defeated the no-confidence motion but also tabled new bills which will replace the existing bills. Besides replacing the old-age laws, a few changes were also proposed.

Indian Penal Code (IPC) is the official criminal code of India and the punishments are given based on that. Now a new bill was proposed in the house which seeks to repeal the IPC. This says that indulging in sexual acts with anyone who is below 18 will be considered rape.

The Bharatiya Nyaya Sanhita, 2023 says that sexual intercourse or sexual acts with girls who are below 18 will be seen as rape and the guilty will attarct a jail term of 15 years. Even if the girl is his wife, the same will be the procedure.

Though the proposal would result in stopping child marriages slightly with this, many say that it would have been good if the government would have provided good clarity on the marital rape issue.

Marital rape is a sensitive topic and we often hear a lot of debates on this. Feminists and activists say that marital rape should be made a crime and should attract punishment if indulged in sexual acts without the consent of the spouse.

But there is a counter-argument for this and a few say that criminalizing marital rape would be a weapon against men like happens in domestic violence cases and hence it should not happen.
