Supreme Court's Historic Verdict On Alimony To Muslim Women!

Law says that if a divorced woman is not financially strong then she can seek alimony from her husband. The rule has been followed for a very long time and we have seen courts giving verdicts on this. In what could be a historic moment the Country’s top court gave a big verdict in this matter.

A bench of the Supreme Court gave a sensational verdict saying that Muslim woman can also get alimony from their husband. Hearing a petition the bench gave the verdict giving the directives. The bench cited Section 125 for the sensational verdict.

A man divorced his wife recently and a lower court directed him to pay an allowance. He challenged the verdict and moved the Supreme Court. The petition was heard by the bench of Justice BV Nagarathna and Justice Augustine George Masih. The bench not only dismissed the petition but also ordered the man to pay the allowance.

During the arguments, the bench reportedly said that Section 125 applies to all women including married women. Adding further the bench said that irrespective of the religion.

The bench said that giving alimony is not a charity but the right of women. Wife is dependent on husband emotionally and other means but some husbands don't understand this, the bench added.

It has to be mentioned here that this is not the first instance where a Muslim woman was given a favourable verdict. Back in 1985, a similar verdict was given to Shah Bano. Cut to 2024 a similar verdict was given.
