It is known that a large portion of the Indian population had been extensively depending on the United States birth citizenship for the last few decades. This earlier regulation granted easy citizenship to anyone who is born in the US soil, and this was countered by the Donald Trump administration.

Earlier, Trump signed the order on his first day in office in January 2025, saying children born in the US to undocumented or temporary status parents weren't entitled to citizenship under the 14th Amendment.

However, this was bluntly rejected by the Supreme Court of the United States and a strong judgement was passed last night, which backs the citizenship right?

Anyone physically present in the US during the time of birth falls under US jurisdiction, the Court ruled. There were only a few narrow exceptions like foreign diplomats. So automatic citizenship for anyone born here stays exactly the way it's always been.

This decision reverses Trump's EO where he tried to deny birthright citizenship to children born in the US to parents who are either undocumented or in the country on temporary visas.

His Executive Order argued that these individuals are not "subject to the jurisdiction" of the United States, and therefore their children do not qualify for citizenship under the 14th Amendment. However, this was disqualified by the Supreme Court and it has been made clear that anyone born in the US will automatically become a citizen.

Trump has been trying extremely hard to sharpen the immigration policies and make it extremely tough for other country individuals to find citizenship in the US. But things have not been going in his favour till now.
